What would you do?

#1 Post by Barry Wolk »

This butt-hole on e-bay has glommed a picture of our Porsche off of the web and is using it to sell his clocks. I'm honored, but I'm also pissed.

What would you do?

I would tell him to cease and desist. You have every right to be pissed.

Barry,
If you took the photo, you own it and can ask the Ebay Seller to stop using it.
Unfortunately, many people think any image they see on the internet is "free to use" even for their own commercial purposes.
A photo of mine was used without licensing by a well-known classic car insurance company in a national magazine ad campaign. I contacted the president of the company and nicely explained the copyright laws to him. He wasn't happy about withdrawing the ad, but he did. Unfortunately, the ad ran in several publications before I stopped them.
Good luck. Suing over the use of a single photo is expensive and probably not a good idea.

I'd tell him to send me a clock for free if he wants to keep using the photo.

Cut a deal with him to have the Goodie Store sell them or you could get royalties from the sales. Beautiful picture!

I don't want the clock! I want the car. It is the prettiest 356 I have ever seen.
But since thats not going to happen, put me down for a clock also.

Barry, whatever you did - it must have worked, as "your" clock is no longer on ebay.

Hemming's has ordered a cease and desist as their staffer took the photo.

However, the perp may produce some clocks with pictures that I own. Would you buy a clock with this picture?
