Peter, It was my understanding that this defendant had been previously convicted TWICE of DUI. Under the three strikes rule (or some such banner, I'm not a lawyer), doesn't Ms. Chois come under the implied malice theory and should be prosecuted for (at least) 2nd degree murder? I hope so.

Apparently, she had just one DUI conviction.

From https://timesofsandiego.com/crime/2016/09/09/trial-ordered-woman-accused-dui-fatal-collision/ and https://patch.com/california/poway/woman-accused-dui-fatal-pomerado-road-porsche-crash-due-court

Choi — who has a 2013 alcohol-related DUI conviction — testified that she got a medical marijuana card in 2014, receiving a doctor’s recommendation to smoke cannibis to help calm her anxiety.

From http://www.kusi.com/story/31641577/woman-killed-in-scripps-ranch-collision-identified-by-authorities

Hyun Jeong Choi, 33, who was on probation for DUI, faces 22 years to life in prison if convicted.

As Peter Silten pointed out "It is common in drunk driving murder cases for the prosecution to introduce evidence of prior reckless or drunk driving incidents for the purpose of showing defendant's knowledge of the associated risks and hazards."

If anyone is interested, there is a long thread in the ferrarichat forum about this: https://www.ferrarichat.com/forum/threa ... ui.517611/

Jon's ferrarichat name is "bullfighter". If you are interested why, see https://smile.amazon.com/Business-Peopl ... warshawsky

I have been very taken by this since it happened, horrible, horrible tragedy, donated to his late girl's kids early on, and praying for Jon's recovery. I truly hope they "throw the book" at the irresponsible complete idiot that messed up so many lives.

MISTRIAL

Hyun Jeong Choi went on trial Wednesday, 20 June 2018.

It looks like one of the police officers gave testimony that was at least "unsupported" and the judge declared a mistrial. A new trial date will be set at a hearing on Monday, 25 June 2018.
